Florida is a strict liability state for dog bites. That means the law does not require proving that the dog owner knew the dog was dangerous or had a history of aggression.

What Does Florida Statute §767.04 Require a Claimant to Prove?

Under Florida Statute §767.04, a dog owner is liable for damages when their dog bites someone who was in a public place or lawfully on private property at the time of the bite.

The claimant does not need to show that the dog had a history of aggression, that the owner had prior warning, or that the owner was negligent.

Specifically, the three elements of a Florida dog bite claim are: the defendant owned the dog, the dog bit the plaintiff, and the plaintiff was lawfully present at the time. Florida eliminated the "one bite rule" that some other states still use, meaning prior incidents are not required to establish liability.

Does the "Bad Dog" Sign Defense Apply in Sarasota?
