Proving Negligence in Personal Injury Claims

Negligence is fundamental in personal injury law. It's the central concept that injured parties use to prove that another person's or entity's reckless or careless action caused them harm. Breach of Duty

The next step is to prove that the defendant failed to act reasonably and honor the duty of care, resulting in unsafe conditions or behavior. Typical scenarios include drivers texting while driving a vehicle, doctors misdiagnosing an illness due to negligence, and store owners failing to clean up spills, causing slip-and-falls. Plaintiffs must also show evidence that the defendant’s actions contradicted what any reasonable individual would do in a similar situation.

Causation

The plaintiff must validate that the defendant’s breach of duty directly caused the injury. They must consider the two elements of causation. First is the actual cause or cause-in-fact, demonstrating that the injury wouldn't have occurred but for the defendant's negligence.

Second is the proximate cause, the agreed-upon act of the defendant that led to the foreseeable injury and damages. For example, when a speeding driver strikes a pedestrian, the latter must show that the speeding directly led to the accident and injuries.

Damages

Although a duty of care, breach, and causation may be well-established, a claim is only valid if the plaintiff suffered actual damages. They typically include medical costs over treatment and recovery, lost wages and other sums caused by the inability to work, and pain and suffering due to physical and emotional distress. To further strengthen the claim, it’s essential to properly document these damages, including medical records, financial statements, and expert testimonies.

When building a compelling case, plaintiffs must collect strong evidence. It can include accident reports, police records, surveillance footage, photographs from the scene, witness statements, and professional testimonies.
